NON-MARITAL COHABITATION

Non-marital cohabitation simply means that two people live in the same house without the benefit of marriage. The parties may have purchased property together and may have children together.

Unlike the other areas discussed, these types of actions are not heard in the family courts, but are heard in general civil courts as a basic breach of contract action, or a partition action regarding the division of any real estate. All issues regarding any children of the relationship are handled by the family law courts.

The issues regarding the children are usually custody and child support, however, paternity can also be an issue. The only difference between these type of actions and a divorce is that spousal support will not be awarded and the matter will be heard in two different courts. The property issues will be heard in a civil courtroom, while the issues regarding any children will be heard in the family law court. Ms. Lemkin is equally comfortable in both courtrooms and can facilitate the coordination between the courtrooms for the client to protect and preserve the client’s right to any assets acquired and to promote the best interest of any children.
