Child custody is probably the most difficult area of any divorce. Each divorce where children are involved has two parents that both love the children and want them to be with that parent. The dynamic sets up an automatic conflict between the parties that must be worked through to achieve the best possible outcome for the children to promote what is in the best interest of the children.
The courts are charged with the responsibility to act in the “best interest of the children.” Given that requirement and standard, the Law Offices of Hollie A. Lemkin makes every effort to assist and guide the client toward that goal. This process is aided with several tools that can be used to achieve that goal. Each appropriate option will be discussed with the client to determine how best to achieve a parenting arrangement that meets the standard set by law and the standards in that family. Each option will also be examined to determine how it fits within the comfort level of each client’s family and what if any, extra factors, such as physical abuse and substance abuse may be at work in any particular families situation.
The marriage may be over, but the family still exists. Each child still has a mother and a father and the parties need to realize that the children did not ask for this situation, they do not want it to exist and they, in most instances, feel very powerless to affect the outcome.
