Child Support

It is commonly believed that child support is simply a matter of plugging certain variables into a formula to arrive at a child support amount. What most people don’t know is that the courts have discretion, in certain instances, to adjust the formula.

The major variables that are used to calculate child support are:

• Timeshare between the parties
• Income of the parties (all forms of income)
• Child care expenses
• Medical Expenses for the children, including insurance.
• Extraordinary expenses for a child’s special needs and/or travel for visitation
• Educational expenses for the children such as tutoring.

Spousal Support

Surprisingly, spousal support can be an even more difficult issue than child support. The issues involved with setting spousal support are more inclusive and at certain times are not strictly formula driven. The initial setting of spousal support is generally formula driven with various other factors taken into account at the permanent setting of support.

Some of the major issues to be factored into the calculation of spousal support include:
• The length of the marriage of the parties
• The presence of domestic violence, if applicable
• The education, skill and training of each party.
• The length of time either party has been the primary caretaker of the children
• The lifestyle of the parties at separation.
• The timeshare with the children
• The need and ability to pay of each party
